David M. Brodsky is the Principal of Brodsky ADR LLC, a mediation and arbitration firm specializing in complex commercial disputes. With over 40 years of legal experience under his belt, David has blazed a legal trail across a vast range of commercial legal services, including shareholder class and derivative actions, patent and licensing disputes, employment discrimination, global distribution agreement disputes, dissolution and valuation proceedings, the purchase and sale of RMBS securities, hedge fund and law firm compensation disputes, software licensing disputes, and officer and director liabilities.
After earning a Bachelor of Arts, Cum Laude, from Brown University, David went on to complete his Juris Doctor, Harvard University in 1967. He served as a Law Clerk in the U.S. District Court, Southern District of New York, and was an Assistant U.S. Attorney for the US Attorney’s Office, SDNY. David rose to become a Partner at Guggenheimer & Untermyer before spending 19 years as a Partner for Schulte Roth & Zabel. He oversaw a legal staff of 200+ people as General Counsel for Credit Suisse First Boston, and spent nearly a decade as Partner for Latham & Watkins before establishing Brodsky ADR LLC in 2012.
The author of more than 50 publications, David’s most recent work includes “Counsel’s Preparation For A Mediation: Creating The Basis For Resolution” and “Five Things Your Client Should Know And You Should Do Before A Mediation.” A frequent public speaker, he is also Chair of the non-profit board for the American Constitution Society for Law and Policy. He is a member of the National Academy of Distinguished Neutrals and of the New York Academy of Mediators and Arbitrators, CPR International Institute for Conflict Prevention and Resolution and a member of its Directors and Officers’ Liability Insurance Committee, the mediation and arbitration panels of Federal Arbitration Inc., the mediation panel of the US District Court for the Southern District of New York, and chairs the audit committee and serves as Vice President of the New York City Bar Association. He is also a member of the American Bar and the New York State Bar Associations. Additionally, he is a life member of the American Law Institute; and a Fellow of the American College of Trial Lawyers. He has been ranked as one of the Top 100 of the Super Lawyers in New York.
A former resident of Scarsdale, New York, David chaired the Scarsdale Procedure Committee, the Joint Administrative Committee of the School Board Nominating Committee, and the Scarsdale Bowl Committee. He and his wife are now residents of New York City, avid golfers, and long distance cyclists, and travel whenever they can.
