Jack Rephan is an attorney and a Shareholder and Director for the Virginia Beach, Virginia, law firm of Pender & Coward, P.C. Before joining the firm in 2007, Jack had over 48 years of experience in the practice of law.

As a member of the bars of Virginia and the District of Columbia, Jack’s legal career has covered a broad range of areas of the law although his current practice is primarily devoted to Construction Law, Government Contract Law, and Alternate Disputes Resolution. His clients include contractors, subcontractors, suppliers, and owners in a host of matters on federal, state, and local construction projects. He also has extensive trial experience in jury and non-jury cases before federal and state courts in Virginia, the District of Columbia and before both the Civilian and Armed Services Boards of Contract Appeals and other federal agency boards of contract appeals, and regularly represents parties to construction disputes in arbitration and mediation.

In 1959 Jack earned his Juris Doctorate from the University of Virginia, School of Law. He also holds a Bachelor’s of Science in Commerce from the University of Virginia. He is a member of member of various bar associations including the Virginia Bar Association, the American Bar Association, the Norfolk-Portsmouth Bar Association, and Virginia Beach Bar Association. He is a member and past chair of the Board of Governors of the Virginia Bar Association’s Construction and Public Contract Law Section and is a member of the American Bar Association’s Forum on the Construction Industry. He is also a member The Associated General Contractors of Virginia, the Associated Builders and Contractors and the Hampton Roads Utility and Heavy Contractors Association and also serves as general counsel for that organization. Aside from practicing law, Jack is the author of several articles on construction law and other subjects, and lectured for many years on construction and public contract law. He also serves as a mediator and arbitrator on the American Arbitration Association’s National Panel of Neutrals.

For his extensive knowledge and numerous contributions to the legal field, Jack has been honored with various awards. He has the distinction of being recognized by Martindale-Hubbell as an AV® rated attorney, the highest such rating available to any individual lawyer. He has also been named by Virginia Business Magazine as one of the best lawyers in Virginia by his listing as one of Virginia’s “Legal Elite.” In 2004, Jack Rephan received the Presidential Award, the Commendation Award in 2011, and the 2013 Associate of the Year Award all from Hampton Roads Utility & Heavy Contactor’s Association.

Jack Rephan has been involved in a myriad of notable cases, including J.W. Bateson Co., Inc. v. Board of Trustees of the National Automatic Sprinkler Industry Pension Fund, 434 U.S. 586, 98 S.Ct.873, 55 L.Ed. 2d 50 (1978), United States v. Acme Process Equipment Co., 385 U.S. 138, 87 S.Ct. 350, 17 L.Ed. 2d 249 (1966), Asphalt Roads and Materials Co., Inc. v. Commonwealth, Department of Transportation, 257 Va. 452, 512 S.E. 2d 804 (1999), District of Columbia v. Pierce Associates, Inc., 527 A.2d 306 (D.C. App. 1987), and District of Columbia v. Savoy Construction Company, Inc., 515 A.2d 698 (D.C. App. 1986).

In addition to being admitted to practice in the Commonwealth of Virginia and the District of Columbia he is admitted to practice before the U.S. Supreme Court and several other state and federal courts.
